We have heard learned counsel for the appellant and learned A.G.A. for the State and perused the impugned judgment.
Admit.
Connect this appeal with Criminal Appeal no. 4645 of 2006.
Office is directed to summon the trial court record within a period of six weeks.
It is contended that appellant was armed with lathi. Co-accused Bhagwan Singh was bailed out by this Court on 21.8.2006. The appellant was on bail in the court below and did not misuse the liberty of bail.
In view of the facts and circumstances of the case, we are inclined to release the appellant on bail during pendency of appeal.
Let the appellant-Pancho be enlarged on bail during pendency of appeal on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Mathura in S.T. No. 405 of 1996 State Vs. Bhagwan Singh and others.
