This is an application for bail moved on behalf of the applicant Prem Chandra indicted in case crime No. 426 of 2005 under section 3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Indargarh District Kannauj.
Heard Shri Rama Shanker Mishra, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that two cases have been shown against the applicant in the gang chart in which the applicant is on bail.
The learned A.G.A. argued that applicant is a member of gang involved in cases of abduction and in case he is enlarged on bail, he will commit other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in all the cases shown in the gang chart , I consider it to be a fit case for bail.
Let the applicant Prem Chandra indicted in case crime No. 426 of 2005 under section 3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Indargarh District Kannauj, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and subject to an undertaking that he will not misuse the liberty of bail by indulging in antisocial activities and commission of other offences.
