Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that there is a cross version of the alleged incident. From both side F.I.Rs have been registered and both sides received injuries. From the prospection side one person received injuries who subsequently died. From the side of the applicant two persons have received injuries which have not been explained by the prosecution. The co-accused Raj Kumar alias Somota has been released on bail by this court on 21.8.2006 in criminal misc. bail application no. 17065 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Kishan involved in case crime no. 75 of 2006 under Sections 323,504,506,308,304 I.P.C., P.S. Fatehabad District Agra be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
