Ram Milan Pal v. State Of U.P. - CRIMINAL MISC. BAIL APPLICATION No. 18083 of 2006 RD-AH 14846 (30 August 2006)
Hon'ble (Mrs.) Saroj Bala,J.
This is an application for bail moved on behalf of the applicant Ram Milan Pal indicted in case crime No. 66 of 2006 under section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Shankargarh District Allahabad.
Heard Shri Rama Shanker Mishra, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that two cases have been shown against the applicant in the gang chart in which the applicant is on bail. The learned counsel pointed out that the applicant was not named in the First Information Report for the offence under section 307 I.P.C.
The learned A.G.A. argued that there is criminal history of the applicant and there is every likelihood of his committing other offences after being released on bail.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in all the cases shown in the gang chart , I consider it to be a fit case for bail.
Let the applicant Ram Milan Pal indicted in case crime No. 66 of 2006 under section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Shankargarh District Allahabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and subject to an undertaking that he will not misuse the liberty of bail by indulging in antisocial activities and commission of other offences.
