  Heard learned counsel for the applicant and the learned A.G.A.

        It is submitted by learned counsel for the applicant that in the present case the information was given by Dr.S.S. Jadaun on 15.2.2006 at 7.35 p.m. in respect of the incident which had occurred on 15.2.2006 at about 3.50 a.m. The deceased has received burn injuries. The applicant, who  is the next door neighbor of the deceased, tried to save her life in which the applicant has also received burn injuries. The deceased was taken by the applicant to the District Hospital Jalaun where her condition was not improved, therefore she was shifted to Gwalior. The deceased was taken to Ghalior where she died on 15.2.2006. At that time the husband of the deceased, father of the deceased and other relatives of the deceased were present there, but after doing the cremation the F.I.R. was lodged by the husband of the deceased against the applicant on 25.2.2006. The naming of the applicant is after thought.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.

Let the applicant  Ranjeet Singh Rathore alias Munna    involved in case crime no. 47     of 2006  under Sections 304  I.P.C., P.S. Madhugarh     District Jalaun be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
