This is an application for bail moved on behalf of the applicant Sanjeev Kumar Singh indicted in case crime No. 190 of 2006 under section 135 of Electricity Act P.S. Mehnajpur District Azamgarh.
Heard Shri Kamal Krishna, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that for the offences punishable under the Electricity Act cognizance can be taken on the basis of the complaint. The learned counsel argued that no cognizance could be taken against the applicant on the basis of the First Information Report in view of the provisions of section 151 of Electricity Act.
The learned A.G.A. argued that rules having been amended and cognizance can be taken on the basis of First Information Report.
Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.
Let the applicant Sanjeev Kumar Singh indicted in case crime No. 190 of 2006 under section 135 of Electricity Act P.S. Mehnajpur District Azamgarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
