This is an application for bail moved on behalf of the applicant Satish Kumar (C.P.281) indicted in case crime No. 344 of 2006 under sections 7/13 (1) (d) Prevention of Corruption Act and 120-B, 323, 384 I.P.C. P.S Kavi Nagar. District Ghaziabad.
Heard Shri Vijay Gautam , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the fictitious recovery has been shown from the possession of the applicant to complete the target. The learned counsel submitted that mere recovery of currency notes is not offensive. According to learned counsel there is no evidence of giving and taking of illegal gratification against the applicant.
The learned A.G.A. argued that applicant had received Rs. 500/- from the truck drivers as illegal gratification and recovery of the said amount has been made from his possession.
Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.
Let the applicant Satish Kumar (C.P.281) indicted in case crime No. 344 of 2006 under sections 7/13 (1) (d) Prevention of Corruption Act and 120-B, 323, 384 I.P.C. P.S Kavi Nagar. District Ghaziabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
