This is an  application for bail moved on behalf of the applicant Aftab alias Kala Arjun   indicted in case crime No. 59  of 2006  under section 25 Arms Act P.S. Kareli  District Allahabad . Heard Shri Sunit Kumar Gupta, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that recovery of one country made pistol and two live cartridges is said to have been made from his possession. According to learned counsel the fictitious recovery has been shown from the applicant.  

The learned A.G.A. argued that there is criminal history of  nine cases against the applicant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The offence is triable by the Magistrate Ist class. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Aftab alias Kala Arjun   indicted in case crime No. 59  of 2006  under section 25 Arms Act P.S. Kareli  District Allahabad,  be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
