Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the F.I.R. is too much delayed. It was lodged on 3.6.2006 at 10.00 a.m. in respect of the incident which had occurred in the night of 29/30.6.2006. The applicant has been nominated in the F.I.R. only on the ground that there had been some mar-peet between the applicant an the deceased on 28.6.2006. There is no direct eye witness account. There is no evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Anil involved in case crime no. 73 of 2006 under Sections 302 I.P.C., P.S. Kalyanpur District Fatehpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
