Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence has taken place in the night of 27.5.2006 at about 9.30 p.m. Its F.I.R. was lodged on 26.5.2005 at about 7.30 a.m. The distance of the police station from the alleged place of occurrence is 7 k.m. The F.I.R. is delayed. According to the F.I. R. itself the deceased an other family members were sleeping at the time of the alleged incident. The applicant and others were seen after the commission of the alleged offence by the witnesses. Contradictory statements have been given by the witnesses under section 161 Cr.P.C.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Guddu alias Nidakat Ali involved in case crime no. 205 of 2006 under Sections 302 I.P.C., P.S. Mirzapur District Shahjahanpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
