Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. It was lodged on 14.6.2006 at about 11.30 p.m. During investigation the statement of Ramesh Chandra was recorded on 16.6.2006 and he disclosed the name of the applicant and other co-accused persons Arvind Rajpoot. The applicant was armed with Kulhari and the co-accused Arvind Rajpoot was armed with lathi. According to the post mortem examination report the deceased has received 10 injuries which was caused by hard and blunt object. None of the injuries was caused by sharp edged weapon. The case of the applicant is distinguishable with the case of other co-accused.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Hannu alias Har Narayan involved in case crime no. 419 of 2006 under Sections 304 I.P.C., P.S. Kulpahad District Mahoba be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
