When this case was called out in the first round, a learned counsel holding the brief of Sri Santosh Tripathi, who represents the writ petitioner in this case, was present. He was granted 10 minutes time to call Sri Santosh Tripathi to justify the non-speaking interim order directing stay of the arrest of the petitioner in case crime No. 151 of 2005 under section 302 I.P.C. Since then over 15 minutes have passed but Sri Santosh Tripathi has not turned up. Even his brief holder has not come back.
The interim order does not contain any reasons for granting the stay of arrest in a murder case. We have gone through the petition and we are unable to find any sound justification for stay of the arrest in this murder case. The writ petition is dismissed for default. Interim order dated 7.12.2005 is vacated.
