This is an  application for bail moved on behalf of the applicant Shaukat   indicted in case crime No.  66 of 2005  under sections 364-A  I.P.C. and 7 Criminal Law Amendment Act P.S. Maduwadih  District Varanasi .

Heard Shri P.K. Singh , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that applicant is not named in the First Information Report  and by the victim in his statement recorded under section 161 Cr.P.c. According to the learned counsel name of the applicant came to fore from the confessional statement of the co-accused. The learned counsel urged that co-accused Nathuni Singh, Anawar alias Neta, Koleshwar Singh, Santosh alias Munmun and others have been enlarged on bail by the orders of this court and the case of the applicant stands at better footing from that of co-accused.

The learned A.G.A. argued that name of the applicant was disclosed by the co-accused.

Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.  

Let the applicant Shaukat   indicted in case crime No.  66 of 2005  under sections 364-A  I.P.C. and 7 Criminal Law Amendment Act P.S. Maduwadih  District Varanasi  , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
