This is an application for bail moved on behalf of the applicant Ajeet involved in case Crime No. 200 of 2006, under section 307, I.P.C., Police station Kurhfatehgarh, district Moradabad.
Heard Sri Mohit Singh, learned counsel for the applicants, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is said to have subjected the injured to assault with knife but no incised wound was found on the person of the injured. The learned counsel submitted that injuries are of simple nature.
The learned AGA submitted that the applicant and co-accused subjected the injured to assault by wielding of knife and opening fire and caused injuries on vital parts of the body.
I have taken into consideration the submissions advanced on behalf of both the parties.
A perusal of the injury report indicates that the injured sustained no incised wound. The applicant is said to have mounted assault with knife. In view of these facts, I consider it to b e a fit case for bail.
Let the applicant Ajeet involved in case Crime No. 200 of 2006, under section 307, I.P.C., Police station Kurhfatehgarh, district Moradabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
