This is an application for bail moved on behalf of the applicant Avdhesh indicted in case crime No. 76 of 2006 under sections 307, 393 I.P.C. P.S. Karvi District Chitrakoot.
Heard Shri Pankaj Dwivedi, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the complainant and his brother did not sustain any injuries. The learned counsel argued that Tej Pratap alias Teji who is real cousin brother of the complainant opened fire at him which did not hit. The learned counsel contended that complainant opened fire at Tej Pratap alias Teji and caused his death.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having not been opened fire, I consider it to be a fit case for bail.
Let the applicant Avdhesh indicted in case crime No. 76 of 2006 under sections 307, 393 I.P.C. P.S. Karvi District Chitrakoot , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
