This is an application for bail moved on behalf of the applicants Azad and Sharif involved in case Crime No. 97 of 2006, under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Sarsawa, district Saharanpur.
Heard Sri Shiva Kant Awasthi, learned counsel for the applicants, learned AGA and have perused the record.
The learned counsel for the applicants submitted that the applicants are on bail in the cases shown in the gang chart.
The learned AGA submitted that the applicants are involved in the case of theft and in case they are released on bail they will indulge in commission of other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicants having been enlarged on bail in the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicants Azad and Sharif involved in case Crime No. 97 of 2006, under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Sarsawa, district Saharanpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned with an undertaking that they will not misuse the liberty of bail by indulging in the commission of crime or anti social activities after being released on bail.
