Heard learned counsel for the parties.
There is no ground to recall/ review of my judgment and order dated 3.10.2005. Through the said judgment writ petition of the applicant was allowed in part and part of the accommodation in dispute was left in tenancy occupation.
Accordingly this application is rejected.
Learned counsel for the landlord respondent states that due to pendency of this application, possession has not been delivered by the tenant to the landlord of the accommodation released for which application under section 23 of the Act is pending. Prescribed authority is directed to immediately deliver possession of the released portion to the landlord. Until delivery of possession tenant shall be liable to pay damages of Rs.100/- per day to the landlord from today till delivery of possession of ground floor.
