This is an application for bail moved on behalf of the applicants Hari Singh, Pravin and Nitesh alias Guddu indicted in case crime No. 326 of 2006 under sections 147, 148, 149, 307, 504 I.P.C. P.S. Etmaddaula District Agara.
Heard Shri Virendra Singh, learned counsel for the applicants, learned A.G.A. and have perused the record.
The learned counsel for the applicants submitted that the applicants and co-accused are said to have subjected four persons to assault. According to learned counsel injuries of all the injured persons are of simple nature with the exception that one injury of injured Pratap Singh is of grievous nature which is on non vital part of the body. The learned counsel argued that there is a cross case of the incident, crime No. 264-A of 2006 under sections 147, 148, 149, 323, 307, 504, 506 I.P.C. and applicant Pravin Kumar sustained injuries in the same course of the incident. The learned counsel submitted that co-accused Udai Bhan Singh has been enlarged on bail by an order of this court dated 29.8.2006 passed in Criminal Misc. Bail Application No. 17984 of 2006 and the case of the applicants is identical.
Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.
Let the applicants Hari Singh, Pravin and Nitesh alias Guddu indicted in case crime No. 326 of 2006 under sections 147, 148, 149, 307, 504 I.P.C. P.S. Etmaddaula District Agara. , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
