A counter affidavit has been filed. Let it be taken on record.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. His name has been disclosed after 15 months of the alleged occurrence. The co-accused Shyamveer has been released on bail by this court in criminal misc. bail application no. 15106 of 2006
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Lal Singh involved in case crime no. 346 of 2004 under Sections 302/34,120-B I.P.C. P.S. Highway District Mathura released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
