This is an application for bail moved on behalf of the applicants Mahesh Chandra and Vijai Pal involved in case Crime No. 43 of 2006, under sections 307, 336, 506, Police station Vijaigarh, district Aligarh.
Heard Sri Sushil Kumar, learned counsel for the applicants, learned AGA and have perused the record.
The learned counsel for the applicants submitted that the applicants are said to have fired at the injured persons. The learned counsel argued that injuries of the injured are of simple and superficial nature.
The learned AGA submitted that role of firing from country made pistols has been assigned to the applicants and injuries are on vital parts of the body.
I have taken into consideration the submissions advanced on behalf of both the parties.
In the X-ray of injuries of both the injured prsons multiple small radio opaque shadows of metallic density having been seen the injuries shall be taken to be of simple nature. Looking to the nature of the injuries, I consider it to be a fit case for bail.
Let the applicants Mahesh Chandra and Vijai Pal involved in case Crime No. 43 of 2006, under sections 307, 336, 506, Police station kVijaigarh, district Aligarh, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
