This is an application for bail moved on behalf of the applicant Pramod Kumar involved in case Crime No. 594 of 2004, under section 25 Arms Act, Police station Thakur Dwara, district Moradabad.
Heard Sri Madan Singh, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant was on bail and being a landless labourer he went away to Delhi for earning his livelihood. The learned counsel argued that summons in Sessions Trial were never served upon the applicant.
The learned AGA argued that bail bonds filed by the applicant in compliance of bail order in the present case were found false and fictitious. The learned counsel submitted that the applicant has sold his property situated in Block Saidnagar.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is in jail since 2.5.2006.The applicant went away to Delhi for earning his livelihood. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Pramod Kumar involved in case Crime No. 594 of 2004, under section 25 Arms Act, Police station Thakur Dwara, district Moradabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
