Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged after recovery of the dead body and and naming of the applicant and other co-accused persons has been made on the basis of the information made by the witness Amar Singh. The statement of Amar Singh was recorded under section 161 Cr.P.C. on 14.5.2006 in which he did not disclose any weapon in the hand of the applicant and other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Gantosh involved in case crime no. 52 of 2006 under Sections 302,201 I.P.C., P.S. Manjhanpur District Kaushambi released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
