Sri R.C.Kushwaha counsel for the petitioner submits that the petitioner was the highest bidder in an auction for grant of fishery lease held on 5.7.04 and 1/4th of the bid was deposited by the petitioner. It is stated that the papers were sent for approval of the Sub-Divisional Officer, Kasaya, Kushinagar, respondent no.3 but no order has been passed. The only prayer pressed by the counsel for the petitioner is that the Sub-Divisional officer, Kasaya, Kushinagsr respondent no.3 be called upon to take appropriate decision in the matter. It is stated that the petitioner has also filed a represented dated 4.7.06, Annexure 4 to the writ petition to the Up Ziladhikari, Kasaya, Kushinagar.
I have heard the learned Standing Counsel also. In the facts and circumstances the writ petition is disposed of with the direction to the Sub-Divisional Officer, Kasaya, Kushinagar respondent no.3 to pass appropriate orders either granting or refusing approval upon the representation of the petitioner foresaid within six weeks from the date a certified copy of this order along with true copy of the representation dated 4.7.06 is filed by the petitioner before the Sub-Divisional Officer aforesaid. It is made clear that no opinion is being expressed by this court upon the merits of the petitioner's case.
