Heard learned Counsel for the applicant and learned A.G.A. and Mohd Irfan learned counsel for the complainant.
It is submitted by learned counsel for the applicant that there is cross version of the alleged incident. From both the sides the F.I.R. have been registered and from the side of the prosecution one person has lost his life and 3 persons received injuries and from the applicant's side one persons received injuries and in both the cases the police has submitted charge sheet. The injuries received by the applicant's side has not been explained. The prosecution has not come with clean hands. Co-accuse Kalua has been released on bail on 29.8.2006 in Criminal Misc Bail Application No. 16152 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Aslam involved in Case Crime No. 143 of 2006, under Sections 147, 148, 149, 307, 302 and 506 I.P.C. Police Station Swar District Rampur be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
