It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. . There is no direct eye witness account. The case is based on circumstantial evidence. The only allegation against the applicant is of hatching conspiracy. Other co-accused Sanjay, Chintoo alias Kavindar and Rakam Singh have been released on bail by this on 11.8.2006, 23.8.2006 and 23.8.2006 respectively.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Brijendra Singh Pramukh involved in Case Crime No. 146 of 2004, under Sections364, 301,201, 120-B, 394, 411 I.P.C. and 3(2)(5) S.C./S.T. (P.A.) Act Police Station Kankar Khera, District Meerut be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicant shall not tamper with the evidence and he shall co-operate with the trial.
