Heard learned Counsel for the applicant, learned A.G.A. and Sri Sanjay Sonkar learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. There is no direct evidence against the applicant. The case is based on circumstantial evidence. The extra judicial confession is there and co-accuse Anil Kumar has been released on bail on 28.7.2006 in Criminal Misc Bail Application No. 15287 of e006 and co-accused Nagendra Kumar Singh alisa Shamsher Singh has been released on bail on 17.8.2006 in Criminal Misc Bail Application No. 16387 of 2006. The case of the applicant is on the same footing.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Mahendra Singh involved in Case Crime No. 59 of 2006, under Sections 302 and 120-B I.P.C., Police Station Sarnath , District Varanasi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
