Heard learned Counsel for the applicant and learned A.G.A. and Sri A.P. Kushwaha learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged in pursuance of the order passed on the application under Sections 156(3) Cr. P. C. There are general allegation against the applicant and other co-accused persons. The applicant is devar of the deceased. Raja Ram Kushawaha the father-in-law of the deceased has been released on bail by this court on 25.8.2006 in Criminal Misc Bail Application No. 17754 of 2006. The case of the applicant is on the same footing with the case of the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sanjay Kushwaha involved in Case Crime No. C-o4 of 2006, under Sections 498-A and 304-B I.P.C. Police Station , Dildar Nagar District Ghazipur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
