Heard learned Counsel for the applicants and learned A.G.A. and Sri M.P. Gupta learned counsel for the complainant.
It is submitted by learned counsel for the applicants that the applicant no. 1 is Jethani and the applicant no. 2 is mother-in-law of the deceased. Both are living separately from the deceased and her husband. They were having no concerned with the deceased and her husband. There are general allegation against the applicants and no specific allegation against them. The case of the applicants is distinguishable with the case of the husband of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Smt Premshila Devi and Smt Lalita Devi involved in Case Crime No. 235 of 2006, under Sections 498-A, 304-B and 201 I.P.C. and Sections ¾ Dowry Prohibition Act Police Station , Gahmar District Ghazipur be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
