HIGH COURT OF JUDICATURE OF ALLAHABAD

HON. R.P. MISRA, J.

HON. SHISHIR KUMAR,J.

Heard learned counsel for the petitioner Sri Lakshmi Kant Trigumeet and the learned counsel for the respondent Sri Shailendra Singh holding the brief of Sri Sanjeev Singh.

It has been submitted by the learned counsel for the petitioner that the petitioner has started depositing the installments, therefore, his title-deed should be returned to him.  It has also been submitted by the petitioner that the entire dues of the bank has not been paid to the bank. If that is so, in our opinion, the title deed of the petitioner cannot be returned unless and until the entire dues of the bank is cleared off.

With these observations the writ petition is dismissed.
