1. A notice under the Stamp Act was issued against the petitioner. Thereafter an order against the petitioner was passed on 6.3.2003. According to the petitioner,
An appeal was filed against the order dated 6.3.2003 and 1/3rd of the impugned amount was deposited before respondent no. 2.
The appeal was allowed on 12.2.2004 but the amount deposited by the petitioner is not being returned to him.
Hence the present writ petition.
2. We have heard counsel for the petitioner and standing counsel for the respondents.
3. In the circumstances of the case, the petitioner may file a representation before respondent no. 2. In case any such representation is filed, it may be decided by respondent no. 2 by a speaking order, if possible, within three months from the date of receipt of the representation. The petitioner will file certified copy of this order; other necessary documents and a duly stamped self-addressed envelope along with the representation. Respondent no. 2 after taking decision will communicate the same to the petitioner.
4. With these observations the writ petition is disposed of.
