Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the F.I.R. of this case is too much delayed. It was lodged after great thought and consultation. The F.I.R. has been lodged on 4.4.20056 at 12. 15 p.m. in respect of the incident which had occurred on 3.4.2006 at about 3.00 p.m. The applicant and other co-accused persons have been named in the F.I.R. because they were seen in the company of the deceased. During investigation no role of causing injuries has been assigned to the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Bhiksha Lal Pasi involved in Case Crime No. 52 of 2006, under Sections 302 and 201 I.P.C., Police Station Manjhanpur District Kaushambi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
