We are in respectful agreement with the reasoning given and the order passed by Hon'ble Mr. Justice D.P. Singh on the 21st of August, 2006.
The previously fixed three years period on deputation of the petitioner-appellant was curtailed and he was sent back on the charge that he was found misbehaving in drunken condition. Show cause notice was issued and he was heard; natural justice was complied with. There are no departmental rules which specifically cover the field of truncating a period of deputation. On general law, no jurisdictional or other error is disclosed on the basis of which the writ Court can interfere. The appeal is dismissed.
