It is admitted that the petitioner has obtained a degree of Adeeb-E-Kamil from Jamia Urdu, Aligarh. It is, therefore, established that the petitioner has not obtained a degree of graduation with Urdu as one of the subject from any recognized University. Adeeb-E-Kamil has been held to be equivalent to graduation in only one subject i. e. Urdu. The distinction in that regard has already been settled under the judgment and order of this Court in Civil Misc. Writ Petition No. 49873 of 2005 decided on 26.7.2005.
In view of the aforesaid, petitioner being not possessed of the prescribed minimum qualifications as required under Rule 8(4) of the U.P. Basic Education (Teachers) Service Rules, 1981 has no right for being considered. Writ petition is, accordingly, dismissed.
