Respondents pray for and are granted 10 days' time to file counter affidavit. Rejoinder affidavit may be filed within three days thereafter.

Counsel for respondent no. 5 has accepted that in the Intermediate Examination the total marks awarded to Smt. Laxmi Trivedi are 219 out of 500. From the merit prepared on the basis of the qulity point marks awarded to the candiates, who had applied for the post of Shiksha Mitra (enclosed as Annexure-6 to the writ petition) it is apparent that the petitioner is alleged to have secured 65.6% quality point marks. The said calculation has been arrived at after recording that the petitioner has secured 328 marks out of 500, which, as admitted to Smt. Laxmi Trivedi, is patently incorrect.
Petitioner has made out a prima facie case for grant of interim order.
Till the next date of listing operation of the order dated 21.7.2006, passed by the District Magistrate, Kannauj, shall remain stayed.
