Jugnu Singh v. State Of U.P. - APPLICATION U/s 482 No. 6556 of 2006  RD-AH 15574 (7 September 2006)
Heard the learned counsel for the applicant and the learned A.G.A. on admission and perused the Division Bench order dated 24.9.2003 of this Court passed in Crl. Writ no. 5772 of 2003, Jugnu Singh Vs. State of U.P. and another, whereby arrest of the applicant was stayed. That stay order has become infructuous after submission of the charge sheet in the case and now present application under section 482 Cr.P.C. has been filed challenging the proceedings on the same grounds.
Notice on behalf of the State has been accepted by the learned A.G.A. He is allowed four weeks' time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter and the case be listed for hearing thereafter.
Further proceedings of Sessions Trial no. 37 of 2005 ( State Vs. Jugnu Singh ), pertaining to case crime no. 434 of 2003 under section 3(1) of the U.P. Gangster and Anti Social Activities ( Prevention ) Act, pending in the court of the Special Judge ( Gangsters Act ), Varanasi, shall remain stayed till the next date of listing.
