It is submitted by learned counsel for the applicant that in the present case no charge sheet has been submitted against the applicant. The applicant has been summoned by the trial court in exercise of powers conferred under Section 319 Cr. P. C. Co-accused Mata Prasad, who is already facing the trial, has been released on bail by this court on 9.6.2005 The role of causing injury is not assigned to the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Harish Chandra involved in Case Crime No. 230 of 2005, Sessions Trial No. 140 of 2005, under Sections 302 and 120-B I.P.C. Police Station Kotwali Urai District Jalaun be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
