Heard Sri Sarvesh learned counsel for the revisionist and Sri P.K.Singh learned counsel for the opposite party.

It has been stated by learned counsel for the opposite party that after the impugned order the witness was examined on 19.10.2005 by the court. He has also filed the counter affidavit and the photocopy of the certified copy of the statement. According to him now it is pending for cross examination of the prosecution.

Considering this the revision has become in fructuous and is dismissed accordingly.

The interim order is vacated.

The trial court is directed to dispose of the trial expeditiously.
