Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification, even his name has not been disclosed by any witness. The only allegation against him is that his name has been disclosed by co-accused Saleem who stated that he has sold the looted property to the applicant and the same has been recovered from the possession of the applicant. The looted property is cycle parts and the applicant was not having any knowledge that purchased articles were looted property and there is no other evidence against the applicant and the applicant is having no criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shamshad @ Shammi involved in Case Crime No. 190 of 2006, under Section 396, 412, 201 I.P.C. Police Station Kharkhauda District Meerut be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
