Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant has been named in the F.I.R. only on the basis of the doubt and suspicion. During investigation the statements of the witnesses have been recorded, in which the role of causing injuries by kicks and fists has been assigned to the applicant and other co-accused persons. Co-accused Lakhan Singh has been released on bail by this court on 24.8.2006 in Criminal Misc Bail Application No. 17500 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kamal Singh involved in Case Crime No. 242 of 2006, under Sections 364, 302, 201 I.P.C., Police Station Sikandrarau District Hathras be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
