Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The only evidence against the applicant is that he was seen by some persons going towards the place of occurrence. He has been named only on the basis of the doubt and suspicion. There is no direct evidence against the applicant. Co-accused Vipin has been released on bail by this court on 7.9.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sachin Kumar Chanda involved in Case Crime No. 144 of 2006, under Sections 302/34 t Police Station Partapur, District Meerut be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
