Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicants that the applicant is mother-in-law of the deceased. General allegations are made against the applicant and other co-accused persons. No specific role has been assigned against the applicant. The deceased has not received any ante mortem injuries. The cause of death could not be ascertained, hence the viscera was preserved. The case of the applicant is distinguishable with the case of other co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicants Smt Kiran Devi involved in Case Crime No. 85 of 2006, under Sections 498-A,304-B,I.P.C. And ¾ D.P.Act Police Station , Gangiri District Aligarh be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
