Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is father-in-law of the deceased. The deceased has died due to burn injuries. It is contended that the deceased in injured condition was taken to the hospital by the applicant. The general allegations are made against the applicant and other co-accused. There is no specific allegation against the applicant in respect of demand of dowry and subjecting the deceased to cruelty. The applicant is old man aged about 67 years. The case of the applicant is distinguishable with the case of other co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sri Jagdish Yadav involved in Case Crime No. 889 of 2006, under Sections 498-A, 304-B and 302 I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Nai Mandi District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
