Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the F.I.R. of this case is too much delayed. It was lodged on 13.10.2005 at about 11.00 a.m. in respect of the incident which had occurred on 11.10.2005 The distance of the police station was about 2 kms from the alleged place of occurrence. It is alleged that the applicant and 3 other co-accused persons had committed the murder of the deceased, but during the investigation the first informant stated that the other co-accused persons have committed the murder of the deceased. The role of causing is not assigned to the applicant and co-accused Mehtab has been released on bail on 24.4.2006 in Criminal Misc Bail Application No. 6053 of 2006. The case of the applicant is on the better footing with the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Yameen involved in Case Crime No. 345 of 2005, under Sections 304 I.P.C. Police Station Muradnagar , District Ghaziabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
