The order impugned dated 01st May, 2006 has been passed pursuant to a direction of learned Single Judge in connection with a pending writ petition. Surprisingly, this writ petition has been filed before this Division Bench challenging such order to obtain stay by showing an interim order of a Division Bench of this High Court dated 21st February, 2006 passed in Writ Petition No. 10051 of 2005 (Deo Narain Ram Vs. State of U.P. and others). There is every likelihood that nobody pointed out such fact to the erstwhile Division Bench at the time of passing such order or the order which was passed by the Division Bench, is not arising out of similar facts.
However, we do not find any merit to interfere with the matter at all. Hence, the writ petition stands dismissed. However, without imposing any cost we are putting caution to him so that he shall be careful in future.
This order of dismissal of the writ petition will not in any way prejudice the petitioner in approaching the learned Single Judge where the matter is pending.
