Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that they are not named in the F.I.R. but they have not been put up for for identification. The total evidence against the applicants is that of extra judicial confession and the recover of one pair Payal and nose ornament. They are bearing no specific mark to show that it is the property which was looted in the alleged offence. The applicants are not having any criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Rahimuddin and Fahimuddin involved in case crime no. 37 of 2006 under Sections 396,412 I.P.C., 2/3 Gangsters Act P.S. Agauta District Bulandshahar be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
