Learned counsel for petitioners urged that petitioners passed X standard from the same College where they are seeking admission and are entitled to be admitted in XI Class. He further urged that there is no other Girls' College within the vicinity of about 10 Kilometers. While referring to allegations made in Annexure-6 to the writ petition, learned counsel for petitioners urged that petitioners are entitled to get admission in Sarswati Vidya Mandir Inter College, Dilari, Moradabad.
Learned Standing Counsel has no objection in case petitioners are admitted in the aforesaid College.
In the facts of the case, learned Standing Counsel is granted three weeks' time to file counter affidavit. Rejoinder Affidavit, if any, may be filed within two weeks' thereafter. List thereafter.
In the meantime, a writ of mandamus is issued to Opp. Party no.5, Principal, Sarswati Vidya Mandir Inter College, Moradabad to admit all the petitioners in Class XI in the College.
