Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. along with co-accused Raghubir and Padam Singh only on the basis of last seen. There is no direct eye witness account and there is no other evidence against the applicant and nothing incriminating has been recovered from the possession of the applicant or his pointing out. The applicant is having no criminal antecedents. Co-accused Padam Singh, whose case is identical with the case of the applicant, has been released on bail by learned Additional Sessions Judge, Moradabad.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kunwar Pal involved in Case Crime No. 777 of 2005, under Sections 302,201, 34 I.P.C., Police Station Kurh Fatehgarh, District Moradabad be released on bail on him furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
