Sri S.S. Bhatnagar, learned counsel for the respondents expired long ago.  The notices issued to engage another counsel have returned back unserved with the remarks that they could not be traced out inspite of best efforts.  The matter was last listed in Court on 30.11.2004 when the notices were directed to be issued to appellant to engage another counsel.  No one is perusing the appeal for the last more than ten years.  Litigants are equally under the duty to prosecute the matter.

The second appeal is accordingly dismissed for want of prosecution.
