This is an application for bail moved on behalf of the applicant Saleem indicted in case crime No. 566 of 2006 under sections 379, 411, 427 I.P.C. P.S. Bhuta District Bareilly.
Heard Shri Aditya Prasad Mishra , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that theft of telephone wire is said to have been committed in July 13, 2006 and recovery was made on 14.8.2006. The learned counsel urged that there are no public witnesses to the recovery and the offences are triable by the Magistrate Ist class.
I have taken into consideration the submissions advanced on behalf of both the parties.
The learned A.G.A. argued that offence of theft of telephone wire is an offence against the society.
The recovery of about 20 Kg. copper wire is said to have been made from the possession of the applicant. The applicant is in jail for the last about one month. There are no public witnesses to the recovery. The offences are triable by the Magistrate Ist class. There is no criminal history of the applicant. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Saleem indicted in case crime No. 566 of 2006 under sections 379, 411, 427 I.P.C. P.S. Bhuta District Bareilly , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
