Supplementary affidavit filed today on behalf of the applicant is taken on record.

Heard learned counsel for the applicant and learned A.G.A. for the State and perused the FIR, and injury reports of Rizwan and Safwan as well as X-ray report of Rizwan.

It is contended that an incident took place on 16.6.2006 at about 10-00 A.M. in which both parties sustained injuries. According to prosecution, applicant and his three brothers are said to have assaulted Rizwan and his brother Safwan and both brothers received two incised wounds on the head. On X-ray, fracture of parietal bone of skull was found. On the other hand, two brothers of the present applicants, namely Zakir Khan and Vakeel Khan sustained injuries in the course of same incident and Zakir Khan had also incised wound on the right hand, which was caused by sharp edged weapon. The Radiologist further found fractures of the nasal bone of Vakeel Khan. The fracture was at the root of the nose.

In view of the cross cases and the injuries on both sides, I am inclined to release the applicant on bail.

Let the applicant-Shaqil Khan be enlarged on bail on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Pilibhit in Case Crime No. 820 of 2006, under Sections 307/324/323/504/506 I.P.C., Police Station-Puranpur, District Pilibhit.
